On Friday, March 25, 2022, the Federal Ministry of Digital Affairs and Transport (BMDV) issued regulations for dealing with the currently incalculable price developments as a result of the Ukraine crisis for road construction measures, addressed to the supreme road construction authorities of the federal states and the Autobahn GmbH of the federal government. The regulations apply with immediate effect and are limited until December 31, 2022. All award situations are covered. The comments on price increases in existing contracts deserve special attention. The instructions for action already known from the pandemic decrees have been significantly clarified and expanded. In terms of procurement law, the crisis is also taken into account by the – almost – mandatory application of the material price escalation clause (No. 19 and 20 of HVA B-StB Part 1.3).
