Law on Foundations and Associations/Clubs
Apart from the traditionally strong role played by associations/clubs in Germany, foundations are also once more coming to the fore.Associations/clubs need legal advice not only with regard to the design of their rules and regulations but also the solution of internal conflicts of competence. We assist boards in finding strategies to solve their association/club's problems. We are convinced that in most cases conflicts need to stay within manageable limits and advise accordingly.
We act as advisors to a large number of charitable associations/clubs which, especially in view of tax regulations concerning their charitable status, need to be especially careful. We offer expert advice on the separation and establishment of non-profit making organizations with limited liability.
We assist foundations and their founders with the establishment and concept of a foundation (within the framework of a will, for example), be it the setting up of an independent foundation or giving additional money to an existing one. Existing foundations are able to take advantage of our lawyers' experience as foundation members or curators.
